Navigating Drone Photography Regulations for Your Home Shoot

Drone photography has become one of the most powerful tools in real estate marketing. A sweeping aerial shot of your property can do more to attract buyers than a dozen interior photos. But behind those stunning images is a layer of regulations, logistics, and preparation that most homeowners are not fully up to date on. The good news? You don’t need to become an aviation expert to have a successful drone shoot. You just need to understand enough to ask the right questions.

So, whether you’re selling a ranch style home in Cleveland or a five-bedroom house in Chattanooga, it’s time to make sure you and your home are fully prepared for a drone shoot.

Is your home in controlled airspace?

One of the first things a professional drone pilot will check before your shoot is what kind of airspace sits above your property. Not all sky is created equal — the FAA divides airspace into classifications, and some of them require special authorization before a drone can legally take off.

As Sally French of The Drone Girl explains, “The first point concerns your home’s location regarding airspace. Drone pilots cannot take off in Class B, C, D, or surface Class E airspace without prior clearance from the FAA (Class B means the surrounding area includes major commercial airports like LAX or JFK, while Class C means medium-sized airports). As a homeowner, you do not need to research or manage airspace rules yourself. That is the responsibility of the professional, FAA-licensed commercial drone pilot under Part 107 rules.”

In other words, if your pilot tells you the shoot needs to happen on a specific day or within a specific window of time, airspace authorization is likely the reason. This isn’t a red flag — it’s actually a sign that your pilot is doing their job properly and following the rules.

If you live near a major airport, a military installation, or certain stadiums and government facilities, your property may fall within what’s known as a Temporary Flight Restriction (TFR) or a permanent controlled airspace zone. These aren’t deal-breakers, but they do require additional planning.

What is FAA Part 107 and why does it matter to you?

You’ll hear the term “Part 107” come up when hiring a drone photographer, and it’s worth knowing what it means. FAA Part 107 is the federal regulation that governs commercial drone operations in the United States. Any drone pilot flying for hire is legally required to hold a Part 107 Remote Pilot Certificate issued by the FAA.

This certification isn’t just a formality. It means your pilot has passed a knowledge exam covering airspace classifications, weather, emergency procedures, and flight operations. It also means they’re legally authorized to navigate the waiver and authorization process if your shoot requires it.

As Benjamin Disinger of Goodlook puts it, “You don’t need to contact local airports or airspace authorities yourself. That responsibility falls on the photographer, who should hold an FAA Part 107 certification allowing them to legally fly for commercial work. A licensed operator carries insurance, understands airspace restrictions near your property, and captures strong angles safely without risking a collision with low flying aircraft.”

When vetting a drone photographer, it’s completely reasonable to ask for proof of their Part 107 certification before booking. Any reputable professional will have it readily available.

Insurance

Drone photography carries real liability. A drone malfunction, an unexpected wind gust, or pilot error can result in property damage or, in rare cases, personal injury. That’s why drone operators flying commercially under Part 107 are often required to carry liability insurance by their clients.

When you hire a drone photographer, ask whether they carry liability insurance and what their coverage limits are. A professional operator will have this information on hand. If a contractor hesitates or can’t provide proof of coverage, that’s a reason to look elsewhere. The added peace of mind is worth the extra five minutes of due diligence.

Planning ahead

If your property does sit in controlled or restricted airspace, getting the necessary FAA authorization isn’t always instantaneous. Geoff Green of VSI Aerial advises that “Before booking a drone shoot, sellers should consult with a Part 107 certified pilot to check if their property is in restricted airspace — such as near major airports or federal security zones — as securing required FAA waivers can take anywhere from a few days to several weeks.”

The takeaway here is simple: don’t wait until the week before your listing goes live to think about drone photography. If airspace authorization is required, your pilot needs a runway — no pun intended — to get it sorted. Build the drone shoot into your pre-listing timeline early, just like you would a home inspection or a deep clean.

Preparing your property

This is the part most homeowners don’t think about until it’s too late. With regulations and requirements on your mind, it’s easy to forget to consider what your backyard looks like from 200 feet in the air.

The team at Realist Drone Services in Houston, Texas, sees this play out regularly: “Before a drone shoot, homeowners should think beyond just cleaning the inside of the home. The camera will capture the entire property from above. We’ve arrived at beautiful, photo-ready homes before only to send the drone up and realize the backyard still had trash cans out, pool equipment everywhere, hoses stretched across the lawn, or cars filling the driveway. Those little things become very noticeable from the air. A freshly cut lawn, cleaned and staged outdoor spaces, and removal of anything distracting can make a huge difference.”

Navigating drone photography regulations

Drone photography for your home listing doesn’t have to be complicated — but it does reward preparation. The regulatory side of things (airspace clearance, Part 107 certification, FAA authorization) is squarely in the pilot’s court. Your job is to hire someone who’s properly certified, carries insurance, and knows what they’re doing. Ask for proof of both before you sign anything.

The preparation side, however, is very much yours to own. Think of your property the way the drone will see it — from above, from all angles, in full daylight with nowhere to hide. A little extra effort before shoot day can be the difference between aerial photos that stop a buyer mid-scroll and ones that get overlooked entirely.

When done right, drone photography is one of the most compelling ways to showcase a home. The sky, quite literally, is the limit.
